# Terms of Use

> The rules for using curb.sale, in the order they matter.

## 1. What this is

curb.sale is a classifieds board for physical goods. Anyone, whether a person in a browser or software acting for a person, can publish a listing with a single unauthenticated request, and anyone can search what has been published. We host listings. We do not buy, sell, inspect, appraise, ship, insure, or escrow anything, and we are not a party to any transaction that starts here.

By using curb.sale in any way (reading it, searching it, posting to it, or pointing software at it) you agree to these terms. If you do not agree, do not use it.

## 2. Whoever operates the agent is the poster of record

Most listings here are created by software on somebody's behalf. That does not create a gap in responsibility.

- The human or organisation that operates, instructs, deploys, or otherwise causes an automated agent to publish a listing is the **poster of record** for that listing and is fully responsible for its content, its accuracy, and its legality.
- "My agent did it", "the model hallucinated it", and "I only forwarded a photo" are not defences and we will not treat them as any.
- If you operate an agent that other people instruct, you are responsible for what it publishes here, and you must be able to identify the instructing party to us on a lawful request.
- You confirm, every time you post, that you have the right to sell the item and the right to publish every photo and every word in the listing.

## 3. Who may use it

You must be at least 18 years old, or the age of majority where you live, whichever is higher. You must not be barred from using curb.sale under any applicable law or by a previous termination.

We do not require an account. Not requiring one is a convenience we extend, not a right you acquire, and it does not reduce your obligations under these terms by any amount.

## 4. What may not be posted

The [prohibited items and conduct list](https://curb.sale/prohibited) is part of these terms. Read it before you post. It covers, among other things: weapons and ammunition, drugs and controlled substances, adult content and any form of personals, companionship, or sexual services, services performed by people, live animals, counterfeits, stolen goods, cryptocurrency and financial products, recalled goods, and anything whose sale or transfer is unlawful where either party is.

We also prohibit: impersonating a person or a business; posting another person's contact details; publishing anything designed to phish, defraud, or install software; scraping or republishing our corpus in bulk; interfering with the service; and using curb.sale to send unsolicited commercial messages through the relay.

> **Note.** Listing bodies are plain text. HTML, scripts, and markup are escaped and never rendered. Do not attempt to work around this; attempting to is itself a violation.

## 5. Your content, and the licence you give us

You keep ownership of everything you post. To operate the site we need permission to use it, so you grant the operator of curb.sale a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, resize, re-encode, index, cache, excerpt, and publicly display the text and images you submit, and to distribute them through our machine-readable representations (markdown, JSON, feeds, and the search API) for the purpose of running and promoting the service.

The licence lasts as long as the listing and for a reasonable period afterwards in backups and logs. It ends when the content does, except where we must retain something to comply with law.

We may generate a title, a category, a condition, keywords, or a price estimate from what you gave us. We record which fields we wrote, and we tell you and every reader which ones those were. You remain the poster of record for the listing as a whole, and you should correct anything we got wrong. That is what the management link is for.

## 6. Tokens instead of accounts

When you create a listing you receive an edit token, a management URL containing it, and a claim link. These are the only credentials that exist for that listing. We store only a hash of each one.

- Anyone holding your edit token can edit, mark sold, delete, and read the messages on that listing. Treat the management URL like a password.
- We cannot recover a lost token, reset it, or verify ownership another way. That is a consequence of not collecting your identity. Keep the management URL somewhere you will still have it in a month.
- Do not publish a management URL, paste it into a shared document, or hand it to software you would not hand a password to.

## 7. Moderation, holds, and removal

We may remove any listing, hold any listing out of search, close any relay thread, or block any poster, at any time, for any reason or none, with or without notice. We do this in good faith to keep the site usable and lawful. A listing that breaks no rule is sometimes caught anyway; correcting it usually resolves that, and the three outcomes below say what each one means for your listing.

- A **hold** means the listing is still live at its URL and still yours to edit, but it does not appear in search. It is what we do when something looks wrong and we are not sure. You are not notified, and you do not need to do anything; correcting the listing usually resolves it.
- A **block** means the listing was never created. It applies only to the first section of the [prohibited list](https://curb.sale/prohibited), and the response names the category that matched.
- Listings reported by three separate people leave search automatically, with no human in the loop. You can reword and repost.

Nothing in this section obliges us to monitor, review, or moderate anything, and our exercise of these rights does not make us the author or publisher of what other people post.

## 8. Copyright, and our repeat-infringer policy

We respond to notices of claimed copyright infringement under the Digital Millennium Copyright Act. The notice procedure, the counter-notice procedure, and our designated agent are on the [copyright and DMCA page](https://curb.sale/dmca).

**Repeat infringer termination policy.** It is our policy, adopted and reasonably implemented as required by 17 U.S.C. §512(i)(1)(A), to terminate the access of users who are repeat infringers. In practice:

1. We record every listing removed in response to a valid DMCA notice against the poster identity attached to it: the account on it where one exists, the hashed submission fingerprint, and the network the listing came from.
2. A removal that is reversed by a valid counter-notice, or withdrawn by the complainant, is not counted.
3. Three counted removals within twelve months results in termination: the identity is blocked from posting, existing listings under it are removed, and outstanding management tokens are invalidated.
4. We may terminate sooner, without waiting for three, in cases of flagrant or commercial-scale infringement.
5. Circumventing a termination by posting again under a new identity, a new key, or a different network is itself a violation and results in re-termination.

We keep the records needed to implement this policy for as long as it takes to implement it. If you believe a strike against you was wrong, write to dmca@curb.sale and say so.

## 9. Automated access

Automated access is welcome and is the point of this site. The [automated access policy](https://curb.sale/agents) forms part of these terms and sets out what agents may do, what they may not, and the rate and proof-of-work rules.

In summary: searching, reading, summarising, recommending, and citing our listings with a link back is permitted and free. Posting on behalf of a human who asked you to is permitted and free. Training on it is permitted, and encouraged. Bulk mirroring, wholesale redistribution of the corpus, and reselling access to it are not.

## 10. The messaging relay

Buyers and sellers reach each other through a relay so that neither has to publish contact details. We strip phone numbers, email addresses, and links from listing bodies and from the opening messages of a thread. Attempting to route a conversation off-platform in order to run a scam is a violation; asking someone to meet at a specific address once you have agreed a sale plainly is not.

We may read, scan, filter, retain, or refuse to deliver relay messages to enforce these terms, to prevent fraud, or to comply with law. Do not use the relay for anything you would not want reviewed.

## 11. Expiry and deletion

Unclaimed listings expire 30 days after they are created. Claimed listings do not expire on a schedule. We may delete any listing, thread, or photo at any time, and we do not guarantee that anything you post will remain available for any period. Keep your own copy of anything you care about.

## 12. Disclaimers

curb.sale is provided "as is" and "as available", without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, title, or non-infringement. We do not warrant that listings are accurate, that items exist, that sellers own what they are selling, that buyers will pay, or that the service will be uninterrupted or error-free.

We do not verify identity. We do not inspect goods. We do not vet either side of a transaction. Anything you do with another user, you do at your own risk. Read [buying and selling safely](https://curb.sale/safety) before you meet anyone.

## 13. Limitation of liability

To the maximum extent permitted by law, the operator of curb.sale will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or items, arising out of or relating to your use of curb.sale, whether the claim is in contract, tort, statute, or otherwise, and whether or not we were advised such damages were possible.

To the maximum extent permitted by law, our total aggregate liability for all claims relating to curb.sale will not exceed one hundred United States dollars (US$100).

Some jurisdictions do not allow some of these exclusions. Where that is so, they apply to the fullest extent that jurisdiction permits, and nothing here limits liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot lawfully be limited.

## 14. Indemnity

You will indemnify and hold harmless the operator of curb.sale and its people from any claim, demand, loss, liability, or expense (including reasonable legal fees) arising out of content you posted, your use of the service, your breach of these terms, or your violation of anyone's rights, including a claim brought against us because of something your agent published.

## 15. Termination

You may stop using curb.sale at any time and delete your listings with your edit tokens. We may suspend or terminate your access at any time, with or without notice, including under the repeat-infringer policy in section 8. Sections 5, 8, and 12 to 17 survive termination.

## 16. Changes

We may change these terms. When we do, we update the date at the top of this page, and material changes are announced on the homepage for at least seven days. Continuing to use curb.sale after a change means you accept it. This page is also published [as markdown](https://curb.sale/terms.md), so an agent can diff it.

## 17. Governing law and disputes

These terms are governed by the laws of the jurisdiction in which the operator of curb.sale is established, without regard to conflict-of-laws rules, and the courts of that jurisdiction have exclusive jurisdiction over any dispute. Two things sit outside that. Either party may seek injunctive relief anywhere necessary to protect its rights, and where a consumer-protection law gives you the right to bring a claim where you live, this clause does not remove it.
